Terms and Conditions

These Terms and Conditions (“Agreement”) govern the online fitness coaching services provided by Barbora Hojdíková (“Coach”, “Company”, “We”, “Us”) to the Client (“Client”, “You”).

These services are designed specifically for women and include online fitness, nutrition, and lifestyle coaching.

By purchasing the Beast Mode Club Coaching program, making a payment, or accessing the coaching platform, the Client confirms that they have read, understood, and legally agreed to these Terms and Conditions.

1. Coaching Services

The Beast Mode Club Coaching program includes personalised online fitness coaching tailored to female clients, including training, nutrition, and lifestyle guidance.

Services may include: personalised training programs, personalised nutrition guidance, regular progress check-ins, program adjustments based on progress, access to the coaching application and materials, direct communication and support, educational resources related to training, nutrition, hormones, and lifestyle.

The Coach agrees to provide professional guidance. The Client is fully responsible for implementation and results.

2. Coaching Commitment, Duration and Cancellation

Minimum Commitment
The Client agrees to a mandatory minimum coaching period of four (4) months. This commitment is binding and cannot be cancelled, paused, or refunded.

Automatic Continuation
After the initial 4-month period, coaching continues automatically on a monthly recurring basis unless cancelled.

Cancellation Policy
After completing the initial commitment, the Client may cancel the coaching by providing at least thirty (30) days written notice via the official coaching app platform.

Refund Policy
All payments are final. No refunds, partial refunds, or pro-rated refunds will be issued under any circumstances, including lack of participation, unused time, or failure to follow the program.

Right to Terminate
The Coach reserves the right to terminate the coaching relationship immediately if the Client violates these Terms, behaves in a disrespectful or inappropriate manner, or fails to complete payments. No refunds will be issued.

Participants must be at least 18 years old to purchase or participate in the program.

By purchasing the program you confirm that you are legally able to enter into this agreement and that the information you provide is accurate.

3. Communication and Client Responsibilities

All communication between the Coach and the Client takes place through the designated coaching application.

The coaching platform includes structured chat channels dedicated to specific topics. The Client agrees to use these channels appropriately based on the nature of their question or request.

The Coach provides support within these channels during business days Monday to Friday within reasonable working hours.

In addition, the coaching program includes group coaching calls, during which Clients may ask questions, receive feedback, and engage in live discussions.

The Client understands that: not all questions will be answered immediately via chat, some topics may be redirected to group calls for efficiency and educational value, support is provided within reasonable boundaries and response times.

The Client agrees to: complete all required check-ins as scheduled, use the appropriate communication channels, actively participate in the coaching process, respect the structure of the program and communication system.

Failure to engage with the coaching process does not cancel this Agreement or any payment obligations.

The Client is responsible for informing the Coach of any relevant changes in health condition, injuries, medications, pregnancy, or any other factors that may affect their participation in the program.

The Coach does not provide unlimited on-demand support and reserves the right to maintain reasonable communication boundaries to ensure quality of service for all Clients.

4. Payments and Billing

Payment must be made before the coaching program begins. The coaching operates on a recurring payment model. All payments are non-refundable once the coaching period has started.

Failure to participate, complete check-ins, or follow the plan does not qualify the Client for refunds or pauses. If a payment fails, access to coaching services and the coaching platform may be suspended immediately.

The Client remains responsible for completing all payments related to the agreed commitment period.

By purchasing the program, the Client agrees not to initiate any chargeback or payment dispute without first contacting the Coach to attempt resolution.

Initiating a chargeback without valid grounds will be considered a breach of this Agreement.

The Coach reserves the right to provide evidence of this Agreement, communication, and delivered services to dispute any chargeback claims.

5. Testimonials, Progress Photos and Marketing

The Client acknowledges that anonymous progress-related content may be used for marketing and educational purposes.

This may include: progress photos without the Client’s face, body measurements or progress graphs, photos of meals, screenshots from the coaching app, photos or videos from coaching calls, client messages or testimonials.

The Client further acknowledges and agrees that coaching calls, including group check-in calls, may be recorded by the Coach for educational, quality assurance, and marketing purposes.

By participating in such calls, the Client gives consent to being recorded. The Coach agrees that any shared content will be used in a professional and respectful manner.

No content will be used in a misleading, harmful, or inappropriate way.

The Client may request anonymisation, including blurring of face, name, or any identifying features.

The Client may also withdraw consent for the use of recordings or content for marketing purposes at any time by providing written notice. This will not affect content already published prior to the withdrawal of consent.

6. Confidentiality and Data Protection

The Coach is committed to protecting the Client’s privacy and handling all personal data with care, confidentiality, and in accordance with applicable data protection laws.

All personal information provided by the Client will be kept strictly confidential and used solely for the purpose of delivering coaching services, communication, and program support.

Personal data may include, but is not limited to:

  • contact details

  • health, fitness, and lifestyle information

  • progress data and measurements

  • photos, videos, and check-in submissions

  • communication records within the coaching platform

By participating in the program, the Client consents to the collection and processing of their personal data for the purposes outlined in this Agreement.

Client data may be processed and stored using secure third-party platforms necessary for service delivery, including but not limited to coaching applications, payment processors, and communication tools. These providers are expected to handle data in accordance with applicable privacy standards.

The Coach takes reasonable steps to ensure that all personal data is stored securely and protected against unauthorised access, misuse, or disclosure.

The Client has the right to:

  • request access to their personal data

  • request correction of inaccurate data

  • request deletion of their data, where applicable

  • withdraw consent for data processing, where legally permitted

Please note that certain data may need to be retained for legal, contractual, or accounting purposes even after a request for deletion.

The Coach will not sell, rent, or share Client data with third parties for marketing purposes without explicit consent, unless required to do so by law.

7. Health Disclaimer and Liability

The Client acknowledges that participation in fitness training, exercise programs, and nutritional guidance involves inherent physical risks, including but not limited to injury, illness, or other health complications.

By participating in the coaching program, the Client confirms that:

  • they are physically and mentally capable of participating in exercise and following general nutritional guidance

  • they take full responsibility for their own health, decisions, and actions

  • they participate voluntarily and at their own risk

The Client further confirms that they have consulted, or will consult, a qualified healthcare professional prior to starting the program if they have any existing medical conditions, injuries, concerns, or uncertainties regarding their health.

The Client agrees to inform the Coach immediately of any changes in health status, injuries, medical conditions, medications, or pregnancy that may affect their ability to participate safely.

The Coach is not a medical professional or healthcare provider.

All information provided within the coaching program, including but not limited to training plans, nutritional guidance, supplement suggestions, and lifestyle recommendations, is intended for educational and coaching purposes only and does not constitute medical advice, diagnosis, or treatment.

Nothing within the program should be interpreted as a substitute for professional medical advice.

The Client understands that results are not guaranteed and depend on multiple factors including adherence, consistency, individual physiology, and lifestyle.

The Coach shall not be held liable for any injuries, health issues, complications, damages, or losses that may occur directly or indirectly as a result of participation in the program.

To the fullest extent permitted by law, the Client releases and holds harmless the Coach and Beast Mode Club from any and all liability arising from participation in the coaching services.

To the fullest extent permitted by applicable law, the Coach’s total liability under this Agreement shall be limited to the amount paid by the Client for the coaching services.

The Coach reserves the right to modify, update, or improve the structure, content, and delivery of the coaching program at any time in order to maintain quality and effectiveness.

8. Intellectual Property

All materials provided within the Beast Mode Club Coaching program are the exclusive intellectual property of Barbora Hojdíková and Beast Mode Club and are protected by applicable copyright and intellectual property laws.

This includes, but is not limited to:

  • training programs

  • workouts and exercise systems

  • nutrition plans and guidelines

  • written content and educational materials

  • videos and visual content

  • documents, guides, and resources

  • program structure, methodology, and coaching systems

  • graphics, branding, and app content

The Client is granted a limited, personal, non-transferable, non-exclusive license to access and use these materials solely for their own personal use.

The Client may not, under any circumstances:

  • copy, reproduce, or duplicate any content

  • share, upload, or distribute materials to third parties

  • resell, sublicense, or commercially use any part of the program

  • modify, adapt, or create derivative works based on the content

  • make content publicly available, including on social media, forums, or shared platforms

Unauthorised sharing includes, but is not limited to:

  • sharing login access

  • sending screenshots, recordings, or downloads to others

  • publishing any part of the program online

Any breach of this section will result in immediate termination of the coaching services without refund and may result in legal action.

The Coach reserves the right to pursue any and all remedies available under law for violation of intellectual property rights.

Access to the coaching platform is strictly personal. Sharing login details or account access with any third party is strictly prohibited and may result in immediate termination without refund.

9. Acceptance of Terms

By purchasing the Beast Mode Club Coaching program, making a payment, or accessing the coaching platform, the Client confirms and agrees that they:

  • have read, understood, and accepted these Terms and Conditions in full

  • enter into a legally binding agreement with the Coach

  • agree to comply with all policies, guidelines, and program structure outlined within this Agreement

  • understand and accept the minimum commitment period and payment obligations

  • acknowledge and agree to the no-refund policy

  • participate voluntarily and at their own risk

  • accept full responsibility for their actions, decisions, and results

  • acknowledge the Health Disclaimer and release the Coach from liability as outlined in this Agreement

  • consent to the collection, processing, and use of their personal data in accordance with the data protection section

  • understand that failure to read these Terms does not exempt them from being bound by them

10. No Guarantee of Results

The Client understands and agrees that individual results may vary and are not guaranteed.

Results depend on multiple factors including, but not limited to, consistency, adherence to the program, individual physiology, lifestyle, and external factors beyond the Coach’s control.

The Coach makes no guarantees regarding specific outcomes, including fat loss, muscle gain, physical transformation, or health improvements.

Privacy Policy

This Privacy Policy explains how personal information is collected, used and protected when you participate in the Beast Mode Club Coaching.

1. Information Collected

We may collect personal information including: name, email address, payment information, fitness questionnaire responses, progress photos, feedback or testimonials.

We may use trusted third-party service providers (such as payment processors and coaching platforms) to operate the program. These providers process data in accordance with their own privacy policies.

2. Use of Information

Personal information may be used for: delivering the program, communication with participants, improving the program experience, marketing and promotional purposes, internal analytics.

Your personal information will never be sold to third parties.

3. Storage and Protection

Reasonable security measures are used to protect personal information from unauthorized access, misuse or disclosure.

However no digital system can be guaranteed to be completely secure.

4. Progress Photos and Personal Data

Progress photos and transformation updates are optional.

Participants may choose whether or not to share these materials.

If submitted, these may be used for marketing purposes as outlined in the Terms and Conditions.

5. Your Rights

Participants have the right to: request access to their personal data, request correction of inaccurate information, request deletion of personal data where applicable. Requests may be submitted via email to the program creator.

6. Policy Updates

This Privacy Policy may be updated periodically. Continued participation in the program indicates acceptance of the updated policy.
